Terms of use

My Last Record is a free website where you set down five songs and share them with up to five people you choose yourself. That is all it is, and all it promises to be. Below, in short, is what you can expect from the site and what the site expects from you.

1. What this is about

These terms apply from the moment you create an account, and to every visit after that.

You can read, save and print this text at any time through the link at the bottom of every page.

Questions and complaints go through the contact form on this site. You will get an answer within five days.

2. A list, not a last will

What you set down here has no legal standing. It is not a will, not a codicil, and not a funeral contract.

Nobody has to carry out your list: not your family, not a funeral director, and not this site. If you want certainty about your funeral, arrange it with a civil-law notary or your funeral insurer. This site is no substitute for either.

Nobody here keeps track of whether you are still alive, and no family is contacted after a death. The people you invited have a link of their own, and it keeps working for as long as you let it.

3. Your account

You sign in with a link sent to your email address. There is no password, which also means that anyone who can get into your mailbox can get into your account. Keep your mailbox well secured.

One account belongs to one person. Do not create an account in someone else's name.

Keep your email address current. If it stops working, you can no longer sign in and your account cannot be recovered.

You can add a note to each record. That text is yours and stays your responsibility. Do not post anything unlawful, insulting or threatening, and nothing that invades someone else's privacy. Content like that can be removed, and if it happens again the account can be closed.

4. The people you share with

You can invite up to five people. They get a link to your list and need no account for it.

Ask people first, before you enter their email address here. If you do not, that is your choice and your responsibility.

A link is a link. If a contact passes it on, there is no way to see that and no way to stop it. Share only with people you trust, which is where the name comes from.

You can pause sharing or remove someone at any time. Their link then stops working.

5. The site as it is

The service is provided "as is" and "as available". There is no guarantee that the site is always reachable, that it works without fault, or that data is never lost.

Features can change or disappear, and the site can be down for maintenance from time to time.

Search results, cover art and audio previews come from Apple's iTunes Search API. That data is not created or checked here, and it can change or disappear. If a preview or a cover goes, your choice stays; only the picture or the sound is gone. The rights to the music and the artwork belong to their rights holders, and this site gives you no license to them.

Keep a copy yourself. You can download your data and print your list at any time. If your list matters to you, do it: it takes a minute, and it is the only real guarantee there is.

6. Liability

No liability is accepted for damage arising from the use of this website, or from being unable to use it. That covers at least: loss of data or being unable to reach it, an email that does not arrive, a share link that does not work, and your music not being played at a funeral. All of this as far as the law allows.

If liability does exist despite the above, it is limited to the amount you paid for this service. That is zero euros.

These limits do not apply in the case of intent or willful recklessness, and not to damage from death or personal injury. The law does not allow that, and it is not attempted here.

If you are a consumer, you can always rely on the protection Dutch consumer law gives you. Nothing in these terms takes that away.

7. Stopping and changes

You can delete your account yourself at any time. That happens immediately and for good.

This site can stop too. If that happens, you will be told at least thirty days in advance at your account's email address, so you can download your data. After that, everything is deleted. The site stopping gives you no further rights: no continuation, no replacement service, no compensation. That comes with a service offered free of charge and without obligation.

In case of misuse, or of acting against these terms, an account can be blocked or deleted immediately.

These terms can change. Every version has a date and a fingerprint, and every version is kept. If something changes that matters to you, you will be asked to agree again on your next visit. If you would rather not, you can download your data and delete your account.

Dutch law applies to these terms. If you are a consumer, you keep the right to bring proceedings in the court where you live.

8. Ownership

The concept, name, design and code of this site belong to its maker. Nothing in these terms transfers any of that to you.

Your choice of records and any notes you write yourself stay yours. By setting them down here, you only give the site the right to store them and show them to whoever you choose, nothing more.

Copying this site's text, design or code without permission is not allowed.
